The American with Disabilities Act is an important civil right statute that guarantees or is supposed to guarantee that an employee cannot be discriminated against by its employer, simply because the employee may have a disability. Often we see cases where an employee is fully able to do all of the important aspects of their job but may need an accommodation in one or two of the less important aspects. For example, where an employee is not required to lift as part of the primary duties; an employer should, as a reasonable accommodation to that employee, shift the lifting duties to another employee so that the disabled employee can continue to do the essential functions of his or her job.
